DEATH ON OR AFTER 1st JANUARY, 1898

BE IT KNOWN that Eveline Forrest of Grimsdyke Prines Risborough in the county of Buckingham (wife of John Forrest)

died on the 27th day of January 1905 at Grymsdyke aforesaid

AND BE IT FURTHER KNOWN that at that date hereunder written the last Will and Testament as contained in papers marked A & B with a Codicil to the paper marked B

of the said deceased was proved and registered in the Principal Probate Registry of His Majesty's High Court of Justice, and that administration of all estate which by law devolves to and vests in the personal representative of the said deceased was granted by the aforesaid Court to the said John Forrest of Grymsdyke aforesaid Esquire George Francis Forrest of Grymsdyke aforesaid Stock Broker son of the deceased and James Balten Winterbotham of Cheltenham in the county of Gloucester Esquire three of the executors

named in the said Will

John Graham Forrest son also of the deceased the sole executor therein defined having renounced probate of the said will and codicil

THIS IS THE LAST WILL AND TESTAMENT or Testamentary Appointment of me EVELINE FORREST wife of John Forrest of Grymesdyke Princes Risborough in the county of Bucks Esquire J P which I make in exercise of all powers enabling me in this behalf I give to my sister Mary cott Macintosh Harford widow of Edmund Harford Esquire one thousand pounds duty free and to her daughter my neice and Godchild Mary Macintosh Lloyd Harford one thousand pounds duty free To my friend Alice Jane Anderson one hundred pounds duty free and To my Housekeeper Harriet Heath my Maid Martha Hammond and my coachman George Timms fifty pounds each duty free if they respectively shall be in my service at the time of my decease I give the Pearls formerly belonging to my dear mother and given to me by my late brother Charles Acintosh Rodger to my eldest son the Reverend John Graham Forrest desiring that the same may not be altered or reset but always preserved as they now are as family heirlooms All other my goods chattels and personal effects (not being moneys or investments or securities for money) I give to my said dear husband John Forrest absolutely feeling sure that he will carry out any wishes which I may informally or verbally express as to the destination of any particular articles I also give and devise to my said husband absolutely the Speen Farm Estate in the county of Bucks aforesaid near to his own property there I give and devise Lots 8 and 9 of the Dunchattan Estate Glasgow (which Lots were given and conveyed to me by my said late brother Charles Macintosh Rodge in his lifetime) to the Trustees for the time being of the will of my said brother Charles Macintosh Rodger to be held by them upon the same trusts with the same powers and for the same intents and purposes as the other portions of the said Dunchattan Estate passing under the Will of my said brother All the rest residue and remainder of my real or personal estate effects and property whatsoever and wheresoever over which I have any disposing power I give devise and bequeath to my Trustees and Executors hereinafter named Upon trust after payment of my just debts funeral and testamentary expenses and the legacies given by this my will or retain or invest in their names in manner hereinafter mentioned the clear net residue of my said estate and to pay and divide the income resulting therefrom to or equally amongst all my sons who shall be living at my decease for and during the joint lives of my said sons and their father the said John Forrest And upon the death of the said John Forrest to pay and divide the capital and future income of my said residuary estate unto or equally such of my said sons as shall be living at the death of the survivor of myself and my said

husband John Forrest absolutely Provided always that if any of my said sons shall have died previous to the time so appointed for the division of the capital of my said estate leaving issue who shall be then living such issue shall take equally between themselves if more than one the share to which their deceased father would if then living have been entitled I direct that the trustees of this my will may retain so long as they shall think fit any investment or security which shall come into under this my will in the state of investment in which it may happen to be at the time of my decease whether within or without the area within which trustees may be for the time being authorised by law to invest but that all new investments made by my said trustees shall be made within the area for the time being by law permitted to trustees I empower my said trustees to apply the income and not exceeding one fourth part of the capital of the presumptive share of any infant beneficiary who may become entitled under the provisions of this my will for his or her maintenance education or advancement in life I appoint my said husband John Forrest my said son John Graham Forrest my son George Francis Forrest and my friend James Batten Winterbotham Trustees and EXECUTORS of this my will and I direct that any executor or trustee for the time being of this my Will shall be entitled to the same propert remuneration for any professional or other business due or transacted by him in relation to my estate as he would have been justly and properly entitled to if he had not been personally an executor or trustee hereof Lastly I revoke all other wills or testmentary appointments by me at any time heretofore made IN TESTIMONY whereof I have hereunto subscribed my name this twenty seventh day of November one thousand nine hundred and three - EVELINE FORREST - Signed by the testatrix Eveline Forrest as and for her last will in the presence of us both present at the same time who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses - REGINALD J WINTERBOTHAM Solicitor Cheltenham - CHAS A PROBERT his Clerk


THIS IS THE LAST WILL AND TESTAMENT of me CHARLES MACINTOSH RODGER of 1 College Lawn Cheltenham Esquire I give to my brother in law John Forrest of Grimsdyke Lodge Princes Risborough the sum of one thousand pounds and to my friend James Batten Winterbotham of Cheltenham aforesaid the sum of five hundred pounds And I appoint the said John Forrest and James Batten Winterbotham EXECUTORS and Trustees of this my Will I give to my friend Frank Fenner the sum of one hundred pounds to purchase some Memorial of me I give to Mr Robert Kirkland (my Doctor) to Frederick William Taylor of Westall Court Farm to Thomas Hughes Sparrow Steward of the Union Club Cheltenham and to Charles Travess Huntsman of the Cotswold Hounds the sum of one hundred pounds each and to the Cheltenham General Hospital the like sum of one hundred pounds I give to Frederick Newman the Farm Bailiff of my estate at Pegglesworth if he shall be in my service at the time of my decease the sum of five hundred pounds and also

an annuity at the rate of one hundred pounds a year for his life such annuity to be payable quarterly commencing from the date of my decease And I direct my Trustees to continue him as such Farm Bailiff whilst the estate shall remain in their hands and management unless and until they shall see cause to the contrary upon terms not less advantageous to him than those of the engagement in force between him and me at the time of my decease I give to his sister Amelia Newman spinster now residing with her said brother on my estate at Pegglesworth if her said brother shall be in my service and she residing with him as aforesaid at the time of my decease the sum of five hundred pounds I direct that my Gamekeeper Samuel Stallard and Sarah Ann Stallard his wife (if they or either of them shall be in my service at the time of my decease) shall have the occupation for their joint lives and the life of the survivor of them of the Keepers Cottage on my said Pegglesworth Estate free of rent taxes or repairs I give to my Butler Walter Smart if he shall be in my service at the time of my decease the sum of one hundred pounds but if at the time of my said decease the said Walter Smart shall have been in my service five years I give to him the sum of three hundred pounds I give to my Housemaid Jane Cryer (who was in the service of my late father and mother) an annuity at the rate of fifty pounds a year for her life such annuity to be payable quarterly commencing from the day of my death if she shall be in my service at the time of my decease and I give to all my domestic servants including my coachman and groom (other than those previously mentioned by name) who shall be in my service at the time of my decease the sum of one hundred pounds each if he or she respectively shall have been in my service for five years or upwards or one years wages if for any less period I direct that the duties upon all the foregoing legacies annuities and bequests shall be paid by my estate All the rest residue and remainder of my real and personal estate effects and property whatsoever and wheresoever I give devise and bequeath unto my said executors and trustees Upon trust in the first place to pay my just debts funeral and testamentary expenses and upon trust to retain or invest in manner hereinafter mentioned the clear net residue of my said estate in their names and to pay the income thereof to or allow the same to be received by my sister Eveline Forrest and her husband the said John Forrest for their joint lives in equal shares and on the death of either of them to pay the whole of the said income to or allow the same to be received by the survivor of them for her or his life And upon the death of such survivor Upon trust as to the capital and income of my said estate to pay or divide the same unto or amongst the children or child of my said sister Eveline in such manner shares and proportions and subject to such conditions and directions as she and her said husband shall jointly appoint by Deed and subject to any such joint appointment (if any) as the survivor of them shall by her or his last Will and testament direct or appoint and in default of such joint appointment by Deed or such appointment by the survivor by will and so far as any such joint or sole appointment or both may not extend Upon trust to pay over and divide the said estate or any portion thereof so

unappointed as aforesaid Unto and equally between such of the said children of my said sister Eveline living at the death of the survivor of the said Eveline and John Forrest as being sons shall live to attain the age of twenty one years or being daughters shall live to attain that age or be previously married I direct that my said trustees may retain so long as they shall think fit any property investment or security which I may hold at the time of my decease whether within or without the area within which trustees may be for the time being authorised by law to invest but that all new investments made by them shall be made within such authorised area I empower my said trustees to apply the income and not exceeding one fourth part of the capital of the presumptive share of any infact beneficiary for his or her maintenance education or advancement in life I direct that my said executors and trustees and any future trustee or trustees who may be hereafter appointed to continue or carry out the trusts of this my will shall have and enjoy all powers and indemnities now or hereafter by law given to trustees and that any or either of them may do or be employed to transact professional or other business in relation to the trust estate with the same remuneration as he or they would have been justly and properly entitled to if he or they had not been personally a trustee or trustees hereof Lastly I revoke all other wills or testamentary dispositions by me at anytime heretofore made IN TESTIMONY whereof I have hereunto subscribed my name this thirteenth day of April one thousand eight hundred and ninety nine - C M RODGER - Signed by the testator Charles Macintosh Rodger as and for his last Will and testament in the presence of us both present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses the alterations against which we have placed our initials having first been made – CHAS A PROBERT – CHAS MOULDER ) clerks to Messrs Winterbotham & Gurney Solicitors Cheltenham.

THIS IS A CODICIL to the will of me CHARLES MACINTOSH RODGER of 1 College Lawn Cheltenham esquire which will is dated the thirteenth day of April one thousand eight hundred and ninety nine I give to my confidential service Walter Toms a legacy of two hundred pounds duty free if he shall be in my service at the time of my decease such legacy to be in addition to any sum to which he might become entitled as one of my domestic servants under my said will if he should be in my service at the time of my decease In all other respects I confirm my said will IN TESTIMONY whereof I have hereunto subscribed my name this twenty eighth day of November one thousand nine hundred and one – C M RODGER – Signed by the said Charles Macintosh Rodger as and for a Codicil to his Will in the presence of us both present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses – CHAS A PROBERT – HARRY C HOLMAN ) Clerks to Messrs Winterbotham & Gurney Solicitors Cheltenham.
